Peg Arguimbau Chairman, Hank Langstroth, Keevin Geller, and Elizabeth McGrath were the members present. Conservation Commission Members Christine Turnbull and Stephen Cremer, were absent from the meeting.
The Conservation Administrator, Greg Meister, was also present.

7:45 p.m., Fred Bottomley - Update on Cranberry Bogs adjacent to Old Post Road:

Fred Bottomley contacted the Commission office requesting to postpone his meeting with the Commission. He is planning to send a packet of updated information to the Commission concerning the condition of the bogs and to arrange another meeting with the Commission.

8:00 p.m., An Abbreviated Notice of Intent Public Hearing filed by David Klayman, MANK, LLC, for the proposed addition to an existing single-family house and other improvements at 164 Beach Street, DEP File # SE-280-0533:

Present:  Homeowners of the proposed project, David and Bonnie Klayman.
               David Oberlander, P.E., from BDO Engineering.

David Oberlander appeared before the Commission to represent the Applicant. He submitted the green abutter cards and a proposed Site Plan entitled, “Conservation Commission Plan for Notice of Intent at 164 Beach Street, Sharon, MA,” dated 11/21/11. David Oberlander explained to the Commission that a portion of the existing house lies within the 100’ Buffer Zone of Lake Massapoag. The closest point of the existing house to the wetland line on the proposed project site is 86 feet.
David Oberlander explained the following scope of the proposed project to the Commission:
  • The proposed construction of a new addition approximately 1,180 +/- s.f. is being proposed
outside of the 100’ Buffer Zone of the wetland resource areas of the proposed project site.
  • All of the proposed new construction lies outside of the 100’ Buffer Zone of the wetland resource areas
      of the proposed project site except for the construction of a new open deck that is being  
      proposed 76 feet away from the wetland line.
  • The Applicant proposes to relocate the existing septic system away from the 125’ Buffer Zone of the wetland resource areas of the proposed project site in accordance with the Board of Health regulations.
  • All of the proposed work is located within the existing lawn area of the project site.
The Conservation Administrator, Gregory Meister, explained to the Commission that the Applicant previously consulted with him and the Building Inspector, Joe Kent, to negotiate an acceptable construction plan for his proposed project.
The Applicant requested guidance from the Commission concerning the restoration of a previously disturbed wetland area at the bottom of the proposed project site near Beach Street.
The Conservation Administrator agreed to flag the previously disturbed wetland area of the proposed project site and to discuss a restoration planting plan with the Applicant.
The Commission agreed to approve the proposed project with the following conditions:
  • The Applicant shall display the DEP file number at the proposed project site before starting the
     proposed project.
  • The Applicant shall contact the Conservation Administrator prior to starting the proposed
     project for inspection of erosion control measures.
  • The Applicant shall finalize, with the Conservation Administrator, the restoration plantings for the proposed project.
Peg called for a motion to close the hearing and to issue an Order of Conditions to the Applicant per submitted plan with conditions as discussed.
Keevin Geller moved. Elizabeth McGrath seconded. Voted. Unanimous. 4-0-0.

The members of the Commission in attendance at the November 17, 2011, No Quorum Meeting, agreed that the minutes reflect the information presented at the meeting.
